Hello Sir,

As per our discussion towards the end of last year, we did explain to you why the videos were age-gated: primarily because they involved nudity of minors. As per our community guidelines, such content has to carry an age-restriction tag – your videos can still be viewed but users will have to sign in before they can view them. In addition, the FPB was at the meeting and they went to lengths to explain to you that this being done in compliance with local laws (in particular, the FPB Act and the Children Protection Act).

It is not exactly accurate for you to say that we have not given you any justification or answer to your queries, but for the benefit of doubt, here are the links again:

Film Africa TV is a television network focused on showcasing reality shows of African Culture.
First YouTube began by age restricting one of our videos. when a video is restricted no video ads will appear on the video. so no money can be generated from the video.
The video is age restricted if YouTube feels that the content is unsuitable for younger viewers. But that was not the case with our video.
so we sent an email to YouTube to reinvestigate the video as below

Thank you for the response. The video is still age restricted please see image attached. It still requires users to login ? i also have logged into the video manager and it is still age restricted?

Thank you for the reply and the decision made. As this is a very sensitive issue. we would like to learn more.
Film Africa TV is dedicated in empowering African culture , in order to protect, inform, educate and expose African Cultures. If we feel that the treatment we receive is unfair or does not recognize our culture. We feel we have the right to be given a clear reason and explanation.?
In order to assist us in getting a better understanding please consider the below;
The specialist team feels the video Virgin test is not complying with your guide lines and policies and therefore did not reinstate it. Could we please have a detailed explanation to what that means ?
If we could please be provided with answers to the following questions?
1- what type of video violates guidelines and policies?
2-How did the YouTube come into conclusion, the factors considered and why ?
3-what part of the video (virgin testing) violates the guidelines and policies.
4-Have you listened to the context of the video ?
5- what is it in the video that must be age restricted ? and why ?
6- There are thousands of such culture videos on YouTube and why specifically this video?
7-Have you considered the value or have any understanding of African Cultures?

– Your members of community ? do you also consider the African people as members of the community? yes or no? (please give explanation)
9 – Do you feel by undervaluing or age restricting our culture violates Africans beliefs? Yes Or No (please give explanation)

Discriminating or stereo typing other races beliefs is a very sensitive issue. And to leave in harmony, we must learn to consider other cultures without judgement , but to see things as they are and not how we been brainwashed to think.
African woman and man in some parts of Africa we believe in our traditional ways of leaving. and woman and kids walk around with their bodies uncovered and to us this is normal and to you may not be.? But just as we consider and respect your western culture, we ask that you consider and respect our cultures too without any distorted view. But with dignity and respect.

I do understand that there are a lot of such videos on YouTube, I’d like to inform that we at YouTube rely on YouTube community members to flag content that they find inappropriate. YouTube staff review flagged videos 24 hours a day, seven days a week, and videos that violate our Community Guidelinesare removed from YouTube. Videos that may not be appropriate for all younger audiences are age-restricted. Flagged videos are not automatically taken down by the flagging system. If a video doesn’t violate our guidelines, no amount of flagging will change that, and the video will stay on the site.
We do consider African people members of our society, however, if any video violates our policies, the relevant team would take the required action. We are not against African culture, as mentioned, the internal team feels this video is not appropriate for the younger audiences. we definitely consider your limitations, but that does not justify our culture values. we still have not got answers as to what it is in this video that must be age restricted as this is a normal lifestyle to us and all ages are involved and exposed to this beautiful culture. we have considered the common factors and non of these match our video.
In our culture young children are not ashamed of their bodies or restricted in natural woman form.
When you age restricting you are only considering the children in your country. To the local children in our culture this is normal. So your team should consider this as it is discrimination.
This culture of shame belongs to the western people and not Africans. As much we consider your limitations in making any decisions. This is a very serious matter that needs a fair closure than just one blanket ban, that is designed to shame other cultures. We feel our values and beliefs are being restricted and attacked.
We request that this matter be passed to YouTube council as soon as possible.
As we again understand that once a video is age restricted it cannot be monetised. This again is a disadvantage on us to benefit like any other race? All our videos are short in this manner. So as far as we see it, this means if the people in the western world decide this is un-appropriate to them?, then it must be to the whole world. This is not true within our culture.
So tomorrow if another individual decided they do not like our videos, then all our videos will be age restricted. This is designed to satisfy other races and not considering the African people?.
We are very proud of our culture and we will never be ashamed. YouTube operates In South Africa and it must consider our values, beliefs and culture without any oppression, racism, or discrimination. And without putting us into disadvantage to monetise our videos.
We would not mind having to put viewers’ discretion in the beginning of our videos?
Can these matter be escalated to the YouTube council so it can be fairly discussed with our involvement and settled?

Have not had any reply to my previous email. we are suffering loss of revenue and need your immediate attention to the below matter.
Please note that on the first reply 1, the support team member (Jose) couldn’t identify the issue. he then further goes to investigate and returns with a reply2. giving reference that the video is not complying with YouTube guidelines and policies.
And since then there was no reply from YouTube so we chose to ignore the issue. we then reuplo-aded the same video that had been age restricted and began monetizing it again.
At this point the video gained more popularity and YouTube this time decided not to age restrict the video but instead blocked ads from showing on the video.
we then decided to resend another email to get more clarification as to what was happening

We now notice that you have targeted our channel and disabled all our most viewed videos.
We are very much interested in hearing from you what it is that is sensitive with our videos? as this is African Culture.
We are Africans and this is our culture. we feel now that this is an insult to attack our beliefs viewing our culture as inappropriate. We as Africans we have the right to generate revenue from our videos just like you do with the raunchy music videos you have all over YouTube platform. There are millions of African culture videos monetized on various documentary channels.
Your actions prove lack of understanding or appreciation of other cultures. This is racism and discrimination and direct attack on our channel Film Africa TV.
As this is a very sensitive matter, and we take racism and discrimination seriously . Could we please have contact details of someone higher up at your department so we could discuss this issue immediately.
Please note that any further delays will result in us losing out on more revenue, and we are going to file proceeding against you to claim and recover our loss of revenue.

you are in violation of civil rights law, Under the belief that our culture violates the company policy. Please see as per the attached document.
YouTube has manipulated our video views and subscribers decreased down below average
since the attack on our channel. YouTube is in abuse of power and dominant position.
we have approached YouTube to give us more clarification. we have asked YouTube to accommodate our values and culture. YouTube has not even tried to respond amicably or find an accommodation.
YouTube has failed to respond appropriately to our complaints.
Failed to investigate and failed to take appropriate remedial action.
YouTube has deliberately and directly discriminated against our channel.
we have been reasonably patient in trying to resolve this matter.
If we do not hear back from YouTube within 24hrs and this matter ends up in court?, we are going to seek damages, loss of revenue and you will be liable for legal costs.
Since the attack on our channel videos not only the videos views have decreased, but also the number of our channel subscribers have decreased to far below average.
